Ohio Department of Education Distributes Notice to Students and Parents:

... partial settlement in students with disabilities class action lawsuit.

The Ohio Department of Education and the United States District Court for the Southern District of Ohio, Eastern Division have issued a notice to students with disabilities and their parents or guardians regarding a partial settlement of the class action suit John Doe, et al., Plaintiffs vs. State of Ohio, et al., Defendants (case: 2:91-cv-464).

 

This lawsuit has two parts. The first is a challenge to the way Ohio funds special education and related services. The second is a challenge to the Ohio Department of Education’s (ODE) procedures for implementing the IDEA.

 

After more than a year of negotiating, the parties have agreed to a partial settlement of this case without a trial. The plaintiffs and defendants have written the agreement in a document called a "Consent Order." The Judge has given preliminary approval of the Consent Order. Before the Judge decides to give final approval of the Consent Order, you can tell the Judge if you disagree with any part of it.
